Talixo Data Privacy Policy:

We would like to inform the user of Talixo about our policies for data collection and data usage. We regard data protection as important and and the trust of our users is important to us. We respect the privacy of our users. The protection of our users’ data in compliance with applicable laws on data protection is therefore important to us. The provisions of collection, application and use of personal data of our users has been put in place to make them feel safe using our services while defining how we adhere to strict regulations.

1. Contacting us in regards to data protection

The responsible body at Talixo for the collection, application and use of personal data as lined out in the federal data protection act is Public In Motion GmbH (hereinafter referred to as “PIM”), Wichmannstraße 7, 10787 Berlin. 2. Collection, application and use of personal data

2.1 Personal data

All personal data (Salutation, Name, Address, Date of birth, Email, Telephone, Fax, Location) is solely used in compliance with federal German data protection acts (Telemediengesetze and Bundesdatenschutzgesetz). This personal data, as long as it is necessary for the reasoning, design or altering the contractual relationship (data on file), is only used for completing the contract agreed on.

2.2 Customer account

In order to book rides on our platform, a user needs to register. A password protected account is then created where the user can access and alter the data on file directly as well as view forthcoming rides. The user is obliged to protect password data to his account keeping it save from unauthorised access of third parties. We are unable to take responsibility for compromised password information unless we were responsible for the act itself.

2.3 Collection, application and use of personal data

We collect, apply and use personal data in the whole process of carrying out car transfers (especially in the function as a commercial agent and while billing), including for liability reasons, technical administration, our own marketing. Personal data is only submitted to third parties if necessary to provide the service agreed by contract, for billing purposes, or if agreed by the user. This typically involves the taxi or limousine company, the driver, and the payment service provider receiving the necessary personal details of the user (name, address, additional job data and telephone number). Third parties are in this context only allowed to use the personal data provided to complete their respective task. Use beyond that is not permitted and will not take place by the third parties that we use. In order to book a transfer, we require name, address, mobile number and payment method of the user. Email address and mobile number are required to confirm bookings and communicate with the user about the booking. The user will furthermore receive information about the driver (name, telephone number, number plate, vehicle type) and updates if necessary through those communication channels. A further use of those details for the purpose of advertising and marketing has to be agreed by the user. The user can agree while registering with us. He can also revoke the agreement  in writing at any time (see 1). The user agrees that usage data will also be used for the purpose of advertising, marketing and the creation of user oriented media design in the creation of user profiles while using pseudonyms. It is always possible to object data usage. Under no circumstances will user profiles be merged using this data.

2.4 GPS Location/Tracking

In order to facilitate a smooth arrangement of transfers, Talixo is making use of GPS location services. Users are being located while using the Talixo-App. While booking over the internet platform, this is not possible. The user agrees that GPS data is being used to locate the user and also use it for identification afterwards.

2.5 Credit card data for payment of transfers

All bookings with Talixo are conveniently settled by credit card. Only in the process of the initial registration, credit card data needs to be provided being processed safe from unauthorized access. PIM does not keep this data. This is done by a certified payment provider named Ayden whose systems are compliant to the highest standards in safety and security such as PCI-DSS-Standard (Payment Card Industry Data Security Standard). To enable comfortably using provided cards for future bookings, the PCI-DSS certified provider is keeping the data on file for one further year.

2.6 Newsletter

Talixo offers its users a free newsletter service. The newsletter is designed to keep the user up to date about topics related to car transfer, special offers and new features. In order to receive the newsletter, the user can tick the “I would like to receive the Talixo newsletter” box in his user profile. Unchecking the box will unsubscribe the user from the newsletter. Every newsletter contains information about how to unsubscribe.

2.7 Other services

The user can link his/her account with additional services such as Facebook (“other integrated services”) and others. If this is done, we may as well receive the above mentioned data including data that is available public in your account from the user and we will use this data as lined out in our privacy policy above.

3. Cookies

Talixo is using so-called “cookies” in order to give you access to a wider range of functions on our website and in order to enable to move more comfortably around the site. “Cookies” are small files that are saved on your computer using your internet browser. If you wish so, cookies can be disabled using the settings menu of your internet browser. Please be advised that this may limit the functionality of our service.

4. Log-files

With every access to the Talixo site, user data is submitted by the respective internet browser and saved in so-called log-files. Such data includes: date and time requesting access to the site, name of the site, IP-address, referal-URL (name of the site that referred you to Talixo), amount of data transferred as well as product and version information from the browser being used. The IP-addresses of the users are being deleted or anonymised after use. If anonymised, the IP-addresses are being altered in a way that details about personal or material circumstance allowing to link it to a particular person cannot be reproduced or only by investing an extraordinary amount of time, cost and labour. We analyse these log-files anonymously to further enhance our booking process, to make it more user friendly, to find errors quicker or use our server capacity more effectively.

5. Privacy policy for using Facebook-Plugins (Like-Button)

The Talixo website uses the social network plugin by Facebook, 1601 South California Avenue, Palo Alto, CA 94304, USA. You can recognise the Facebook-Plugin  by the Facebook logo below the “Like-Button” on our site. A list of Facebook plugins can be found here: http://developers.facebook.com/docs/plugins/. When visiting the Talixo website, the plugin establishes a direct link between browser and Facebook server. Facebook therefore recognises that the user is visiting Talixo with his/her IP address. If the user hits the “Like-Button” while being logged in to his/her Facebook account, he/she can link Talixo context to the Facebook profile. This way, Facebook can link the visit to Talixo’s website to the user’s account. We would like to point out that we as a provider do not get to know the content of the data submitted to Facebook and how Facebook uses this data. Further information on that can be found in the privacy policy of facebook under http://en-gb.facebook.com/policy.php. If the user wishes Facebook to not link his visit on the Talixo website with Facebook, the user should stay logged out of his/her facebook account.

6. Privacy policy for using Google +1

The Talixo website is integrated with the plugin "Google +1" provided and operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ("Google"). Using the Google +1 button, the user can publish information worldwide. Using the Google +1 button will enable you and other users to receive personalized content from Google and our partners. Google collects data of the user that provided +1 for a content as well as the site that the user was viewing while providing +1.  Your +1 can be displayed as suggestions together with your profile name and photo in google services, such as search results or your profile, or in other places on websites or adverts on the internet. Google logs information about your +1 activities in order to improve Google services for you and others. In order to use the Google +1 button, you need a globally visible, public Google profile, that at least needs to contain the chosen name used for the profile. This name is used in all Google services. In some cases this name can replace another name that you used while sharing content via your Google account. The identity of your Google profile can be displayed to users that know your email address or know about other information that identify you.

Besides the above mentioned purposes, the data provided by you will be used in compliance with the Google privacy policy. Google may publish combined statistics about the Google +1 activities of its users or may forward these to partners such as publishers, advertisers or linked websites.

7. Privacy policy for using Google Analytics

The Talixo website is using Google Analytics, an analytics service by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ("Google"). Google Analytics is using so-called "cookies", text files, that are being saved on the users’ computer enabling an analysis of the users’ website usage. The information created by the cookie about the way the site is used is usually transmitted to a Google server to be saved there. In case IP anonymisation is activated on this website, your IP address will be shortened within the member states of the European Union or other states linked by contract to the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of the Talixo website, Google will use this information, to evaluate the usage of the site, to create reports on the activity on the site and to provide further services in relation to website and internet usage to us. The IP address provided to Google analytics by the browser of the user will be linked with other data at Google. The user can disable cookies in his browser settings, while we would like to point out that the user may not have access to all functionality of the website in that case. The user can however prevent Google from collecting data through cookies (including IP address) and using this data by downloading and installing the plugin found here: https://tools.google.com/dlpage/gaoptout?hl=en

8. Sharing data with Facebook and other services

If your account is linked to your Facebook account or if your account  is integrated in another way with services, the default setup will be, that Talixo will share your activity and its updates with this service. This means, that this kind  of information is added or may be published to your Facebook account or the other integrated service. The transfer of information to Facebook or other integrated services can be disabled in your account settings at any time.

Talixo allows you on an individual basis with third parties to share content using the share function. Please be advised that sharing such content using a third party will occur as activity on that third party regardless of your account settings. In order to share a single content with a third party service, it is necessary, to enter the login details of that service. Talixo may save your username and an access token or similar login data, that the other service provides, so that you are able to share certain individual content on the third party service, without needing to provide your login details again in the future.

It should be made clear here that data usage of Facebook and other third parties is subject to their privacy policy while data usage of Talixo is lined out here.

9. Secure data transmission

Personal data of our users is transmitted securely being encrypted. This applies to bookings as well as to logins. We are using SSL (Secure Socket Layer). Although we are not able to guarantee absolute security, we protect our website and services through technical and organisational provisions against loss, access, change or circulation by unauthorized persons.

10. Deleting your data

As long as users data is no longer needed for the purposes lined out, it will be deleted. If data needs to be stored for legal reasons, it will be locked. This data will then no longer be accessible for use.

11. Right to access and rectification

The user does of course have a right upon request to get information provided as to what personal data of him/her Talixo has collected. Similarly, the user has a right to have incorrect data blocked or deleted. You can contact us here via datenschutz@talixo.de or by post using the above mentioned address.

12. Altering the privacy policy

PIM reserves the right to alter this data privacy policy. The current version is always available under www.talixo.de/page/data-privacy-statement/

13. Applicable Law and language of the contract

This Policy shall be governed by and construed under the laws of Germany.

This Policy is drafted in German and English. In the event of any inconsistency between the German and the English version of this contract, the German version shall prevail.
